To Claim or Not to Claim?

To determine if a repair may be an insurance claim or something at the scheme's cost (repairs and maintenance) one needs to answer a basic question
Is there a defined date/time of the event?

You know that rust occurs in your car over time, or your tyres go bald, and is not something your insurance company will pay to fix, this is because there is no defined event at one point in time.

But if you drive your vehicle it into a wall (impact damage), say on 1 January 2013 at 10am, or a brick is thrown through your home window on that date, your insurer will pay.  These are examples of a defined event - something happened at one point in time.  Ie one minute it was fine - good as new - and the next it was in need of repair

Emailing of meeting information and levies

Many agents in our industry have not given scheme’s the option to pass a bylaw to allow the emailing of information, as this will reduce income to strata managers.

We put this option on our AGM agendas for all scheme’s last year and most agreed to give owners this choice. It is something each owner must sign up to – you can complete the attached form and send it to us. Either meeting information or levies, or both can be sent via email.

Whilst there is still a requirement to have an Australian address for service on the strata roll, costs to your scheme are reduced and ensures prompt delivery of information.

Requirement to provide tenant details

Under S119 of the Strata Scheme's Management Act it is a requirement to inform the strata manager within 14 days of a lease being signed in relation to a lot providing the following information:  the name of the lessee, the date it commences and the name of the agent acting for the owner in this regard.  If you lease out the property yourself, you are still required to provide this information, however the name of the agent, if you have none, is not applicable.

Children, Windows and Safety

There have been recent changes regarding the safety of windows, particularly regarding height, due to the number of children falling from them.

A motion is on your AGM agenda to make a decision re handling this new legislation.  Attached is some information that will be sent with the agenda for the owners to consider as to options as to how they wish to handle the issue in their scheme.  Bannerman's have provided some very practical advice on this issue.  We look forward to discussing this with you at your AGM.
